Fleet Insurance and the Law
Published: 21/01/10

These days, practically everyone owns a mobile phone. Be they a school or university student, a business person or a grandparent, it seems every person you pass in the street is on a mobile phone. It’s becoming more and more popular to talk or text on the phone whilst driving – and many are not aware of, or simply do not care about, the risks involved with talking on a mobile phone while driving. It is not only against the law, it is plain dangerous. If you or someone driving one of your cars is caught doing it, you not only put innocent bystanders at risk in the case of an accident, but you can put your fleet insurance at risk, too.

If the person in charge of a vehicle in your fleet (be it a taxi, delivery vehicle or other) is caught breaking the law and convicted, the mark on their record could mean your insurance premiums may increase. Worse case, your policy may be cancelled and it will be very difficult – if not impossible – to get insurance coverage anywhere else.

Speaking on a hands-free may be legal, however it may not be safer. Anything that detracts from your concentration (critical when driving) can be dangerous. The best way to avoid a conviction for one of your drivers is to prohibit them from using a mobile phone – in some cases this may mean they need to switch off the engine and actually get out of their car, not simply pull over to the kerb.

If the risk to your motor fleet insurance is not enough to worry you, think about the goods in the vehicle that could be damaged in case of an accident. Your fleet insurance policy might not cover the personal goods being delivered (or owned by the driver) if an accident occurs and they are damaged beyond repair. Something as simple as a mobile phone should not be allowed to cause this much inconvenience to you and your business.
