Protecting your business from common claims during hard times
Published: 19/02/10

Everybody has heard of the McDonald‘s coffee case; the 1994 product liablilty lawsuit that awarded an undisclosed amount of money to a woman who burned herself with hot coffee she had purchased from a McDonald‘s restaurant. The case entered popular understanding as an example of a frivolous litigation, a farcical lawsuit that is nothing than a waste of time, resources and legal fees.

Therefore, if you run a business, it is highly advisable to insure yourself against damage or injury to a third party or against people that simply refuse to take responsibility for themselves and instead call someone else to account for their faults. Public liability insurance can protect you against the number of dangers your business property keeps ready. An inattentive moment and your customer runs into the closed glass door, breaks his nose and legally blames you for not sufficiently indicating the obstacle. Or they tumble down a flight stairs, becoming injured and accusing you for the slippery floor that made him incapable of working for weeks. Not mentioning his physical pain you would have to pay for.

The law that focuses on civil wrongs is called public liability and should be part of your commercial property insurance. It covers you for your legal liability when you are found to be responsible for damage or personal injury to a third party or their property, which is caused by an occurrence in connection with your business. The most common types of claims fall into a small number of categories like slips and falls, stress and anxiety due to hold ups or elevator malfunctions, as well as falling objects.

If you consider shortening your commercial property insurance policies during economic hard times like the current recession, you should keep in mind that with lawyers that take legal liability cases without charging their clients fees until their law cases are won, unfortunate falls and sudden claustrophobia can occur faster than you think - and quickly cost you a fortune.
